Driver busted for 5th OWI

Revoked 11 years ago, his license was not reinstated

Christopher Avilez, 39, Stevens Point, is charged with a fifth drunken driving offense and misdemeanor operating while revoked.

He was also cited for possession of a controlled substance and operating a vehicle without insurance.

At 9:30 p.m. Friday, Jan. 12, Waupaca Police Officer Sam Van Dinter observed a 2005 silver Saturn going eastbound on West Fulton Street with its high beams activated.

When Van Dinter approached the vehicle, he detected the odor of marijuana. He also noted the driver, Avilez, had bloodshot and glassy eyes.

According to the criminal complaint, Avilez said he had smoked pot about 10-15 minutes earlier. Van Dinter found marijuana when he searched Avilez.

Avilez was taken to ThedaCare in Waupaca, where blood was drawn and sent to the state crime lab.

Court records indicate Avilez has four prior drunken driving convictions from 1998 to 2006.

His license was revoked on Aug. 4, 2006, and not reinstated.

Avilez has six convictions for operating while revoked since 2004.

He was released from custody on a $5,000 signature bond.
