Felon faces sex crime charges

A Fremont man is in jail on a $10,000 cash bond after he allegedly sent explicit images to a 15-year-old girl.

David R. Thurber, 38, is charged with using a computer to facilitate a child sex crime, causing a child to view sexual activity and exposing his genitals to a child.

He also faces two counts of battery to an officer and resisting an officer.

On Dec. 3, 2018, a 15-year-old girl reported receiving inappropriate Snapchat messages from Thurber.

She knew him through a high school friend.

She blocked Thurber from her account, but her father suggested she unblock him to see how far Thurber would go.

According to the criminal complaint, Thurber first sent the girl an image of himself wearing sweatpants so she could see the shape of his genitals. Then he allegedly sent her an image that exposed his genitals.

After speaking with the girl, Detective Sgt. Patrick McClone and deputies Clint Schroeder and Patrick Gorchals went to Thurber’s home to arrest him on a probation hold.

Thurber had been convicted of possession of narcotics in Winnebago County on Nov. 2, 2016, and placed on two years of probation.

When the officers arrested Thurber, they also handcuffed him and took his cellphone.

As McClone was retrieving phone numbers from the phone, Thurber allegedly lunged at the deputy and slammed his arms into McClone’s hands in an apparent attempt to break the phone.

McClone’s hands were cut during the incident, the complaint says.

Thurber reportedly flailed his arms and was escorted to the ground.

McClone and Gorchals suffered physical injuries during the arrest, according to the complaint.

If convicted of using a computer to facilitate a child sex crime, Thurber could serve up to 40 years in prison.

He has spent much of the past 12 years behind bars.

On June 11, 2003, Thurber was convicted in Winnebago County of substantial battery and placed on 4 1/2 years of probation with 12 months in jail.

On Nov. 27, 2006, Thurber’s probation was revoked and he was sentenced to 14 months in state prison.

On Feb. 27, 2009, Thurber was convicted in Outagamie County of felony strangulation and misdemeanor battery as acts of domestic abuse and resisting an officer. He was placed on four years of probation with one year in jail.

On Jan. 26, 2011, his probation was revoked and he was sentenced to 44 months in state prison.

On Nov. 25, 2014, Thurber was convicted in Outagamie County of felony possession of marijuana and he was placed on 18 months of probation.

On April 4, 2016, Thurber was convicted in Waupaca County of fourth-degree sexual assault and placed on two years of probation.

On Nov. 2, 2016, Thurber was convicted in Winnebago County of felony possession of narcotics and placed on 24 months of probation.

On May 8, 2018, Thurber’s marijuana probation was revoked and he was sentenced to one year in state prison.

On Oct. 26, 2018, Thurber was released from prison and placed on extended supervision.

On Jan. 15, Winnebago County revoked Thurber’s probation for possession of narcotics and sentenced him to 18 months in prison.
