Three busted for selling pot

A month-long investigation led to felony charges.

Allen R. Sharp, 21, Weyauwega, is charged with two counts of delivery of marijuana and two counts of delivery of marijuana near a park.

Gavin H. Durrant, 18, Waupaca, is charged with two counts of possession of marijuana with intent to deliver and one count of possession of marijuana near a park.

Avry A. Phelan, 20, Waupaca, is charged with possession of marijuana with intent to deliver near a park, maintaining a drug trafficking place, misdemeanor bail jumping and possession of drug paraphernalia.

According to the criminal complaint, Sharp sold two ounces of pot for $400 to a confidential informant (CI) on March 15 and one ounce of pot for $220 to a CI on March 22.

Both sales were allegedly made from his home on Mill Pond Circle, Weyauwega.

A CI allegedly bought 1 ounce of marijuana for $300 on April 10 and one-quarter pound of pot for $900 on April 15 from Sharp at Riverview Park in Waupaca.

Investigators say that both times, Sharp and Durrant drove to the park, and then Durrant walked to Phelan’s home on the 300 block of Waupaca Street. Durrant returned and the transaction was made in the parking lot, the complaint says.

On April 15, officers executed a search warrant at Phelan’s home on Waupaca Street.

Phelen allegedly fled through the back door before he was arrested.

Officers reported finding 1.3 pounds of marijuana in the backpack, as well as $511 in cash, of which $320 was from the money the CI used to buy pot from Sharp.

Phelan was released on a $6,000 signature bond.

Sharp was released from custody on a $6,000 signature bond co-signed by his grandmother.

Durrant remains in jail on a $6,000 cash bond.

On April 5, Durrant was convicted of possession of marijuana, possession of drug paraphernalia and misdemeanor bail jumping. A felony charge of delivery of marijuana was dismissed but read into the court record.

Judge Troy Nielsen placed Durrant on two years of probation with the conditions that he not possess any illegal drugs, maintain absolute sobriety, fully participate in any counseling deemed appropriate by his probation agent and obtain a high school equivalency diploma.
