Hortonville traffic stop leads to marijuana charge

Brandon M. Allard, 27, Clintonville, is charged with felony THC possession-second offense, operating while revoked-fourth offense and possession of drug paraphernalia in Outagamie County.

Allard was released on a $1,500 signature bond in April but did not show up for a May 7 court appearance.

He was taken into custody on a bench warrant on Monday, May 13.

His next court appearance is scheduled for July.

Allard faces up to 3 1/2 years in prison if convicted of THC possession.

According to the criminal complaint:

On April 18, Hortonville Police Officer Bryan Hauser pulled over Allard’s vehicle because his driver’s license was suspended.

Allard stopped and stepped out the vehicle to ask Hauser why he pulled him over.

After Hauser explained, Allard presented an ID card and admitted to not having a valid driver’s license.

Allard said his license had been revoked for a prior OWI offense, according to the criminal complaint.

During the conversation, Hauser smelled marijuana. He searched the vehicle and found a bag of marijuana and a pipe.

Allard had been convicted of misdemeanor possession of THC in Winnebago County on Feb. 19 and ordered to serve one year of probation.

By possessing THC and drug paraphernalia during the Hortonville traffic stop, he violated his probation conditions.

Allard was convicted of operating a vehicle while revoked, a misdemeanor, three times last year in Outagamie, Dodge and Shawano counties.

His operating privileges were revoked following a second OWI conviction in Walworth County last October. An operating while revoked charge was dismissed but read into the record.

Allard faces two more operating while revoked charges in Waupaca County.
