Hart cited for OWI

Waupaca modifies agreement with city attorney

The Waupaca Common Council unanimously approved modifications to the agreement with its city attorney when it met earlier this month.

All council members were present.

The council met in closed session before returning to open session and approving the modified agreement with Hart Law Office, specifically Tom Hart, for continued service with the city.

At about 8:30 p.m. Monday, Jan. 20, Waupaca Police Officer Tom Grant stopped a red 2018 Subaru at the corner of West Fulton Street and Western Avenue for running a red light.

The 42-year-old Hart was the driver.

Grant cited Hart for a first offense of operating while intoxicated and for violating a red traffic light.

Hart is scheduled for circuit court intake on March 2.

Agreement modifications

• Hart agreed to participate in and complete an Alcohol and Other Drug Abuse Assessment at a center acceptable to the city, at his expense.

• He agreed to participate in any recommended counseling and provide the necessary releases allowing the counseling center to verify to the city his completion of the assessment, participation in any recommended counseling and that he is abiding by the center’s recommendations.

• Hart cannot represent the city in any drug or alcohol enforcement matters while matters involving him personally are pending.

• If he engages in further activities resulting in drug or alcohol violations or citations impeding his ability to provide services to the city and/or bring discredit to the city, the city has the right to immediately terminate the agreement without notice.

The city entered into an agreement with Hart Law Office on Jan. 15, 2002 for legal services.

The agreement was extended on Nov. 17, 2017 and is currently extended to Jan. 15, 2022.
