Deputies say Ogdensburg bar failed to close

Shaun M. Boutwell, 39, Ogdensburg, is charged with violating Wisconsin’s emergency health order.

Deputies say he failed to close Shaunie B’s Bar in Ogdensburg by 5 p.m. Tuesday, March 17.

At 6:29 p.m. March 17, an anonymous 911 caller reported that Shaunie B’s Bar was still open and there will about 15 cars in the parking lot.

At 7:24 p.m., Deputy Hailey Casari called the bar and told the owner, Boutwell, that all bars had to close by 5 p.m. due to the COVID-19 pandemic.

According to the criminal complaint, Boutwell said he was under the impression that bars did not need to be closed to the public until Wednesday.

Casari explained that the closing time was 5 p.m. Tuesday.

“Shaun seemed very understanding and was being very cooperative, stating he would have everyone out within an hour,” the complaint says.

A second call came into dispatch shortly after 8 p.m., reporting that the Ogdensburg bar was still open and there were people inside.

Casari called Boutwell again and said he needed to shut down the bar and have everyone out.

She explained that bars can only be open for take outs and deliveries.

At 8:45 p.m., Casari drove past the bar and there were sill people inside.

There were still people in the bar at 11:23 p.m.

The alleged offense is a misdemeanor and carries a maximum penalty of 30 days in jail and a $500 fine.
