Driver to plea on four felony OWIs

Waupaca man accused of huffing while driving

A Waupaca man will appear in court on Monday, Oct. 19, for a plea hearing and sentencing on four felony OWIs.

Police or motorists found the man passed out in his vehicle all four times with a can of aerosol spray dust remover.

Joshua D. Stocker, 43, Waupaca, is charged with four counts each of a fourth OWI and four counts of intentionally abusing a hazardous substance.

In 2019, Stocker was charged with a third OWI five times. He was convicted of one of the 2019 OWIs on Oct. 1.

The remaining four misdemeanor cases were refiled as felony cases the following day.

On March 19, 2019, a 911 caller reported seeing a male driver in a black Altima, huffing from a can of computer spray cleaner.
The caller said the vehicle was headed north on Nichols Creek Road.

Department of Transportation records indicated the vehicle’s license plate belonged to Stocker who lived on Casey Road.

Waupaca County Deputy Curtis Much located the vehicle on Casey Road near Stocker’s address.

According to the criminal complaint, the vehicle was stopped in the roadway, the engine was running and the driver was passed out with a can of aerosol spray between his legs.

Much knocked on the driver’s window several times before Stocker awoke.

“When he woke up he appeared disoriented and very confused,” the complaint says. “Joshua reached several times to try and open the door, unable to successfully do it as his hands kept falling off the latch. He tried to roll down the window but could not find the button to roll it down.”

Stocker was arrested, charged with a third OWI and then released from custody after posting a $5,000 cash bond.

On March 22, 2019, Waupaca Police Officer Brent Wittman was dispatched to Nichols Creek Road for a vehicle in the ditch.

When Wittman found the vehicle, the driver, identified as Stocker, was unconscious and had a can of duster spray in his lap.

On June 11, 2019, police found Stocker unconscious behind the wheel of his car, holding a can of aerosol spray.

On July 25, 2019, police arrested Stocker while he was driving on West Fulton Street near the Pick ‘n Save in Waupaca.

While Stocker was having a blood draw at the hospital, officers found a can of aerosol spray in his vehicle.

Stocker was released from custody after posting a $10,000 cash bond.

On Oct. 1, Stocker was convicted for a May 15, 2019, OWI arrest. His bond was revoked, and he has since remained in jail.
