ATVs allowed on city streets

Clintonville passes ordinance

ATVs and UTVs will be allowed on streets in Clintonville starting May 1.

At its April 13 meeting, the Clintonville City Council approved the second reading of the ordinance that allows ATV/UTV operators to use city streets.
There are some restrictions as to which streets are allowed to have ATV/UTV traffic.

The ordinance establishes ATV/UTV routes within city limits, and regulates the vehicles in the city. Some of the highlights of the ordinance include the following.

ATVs/UTVs must be operated only on roadways that are designated as all-terrain and utility terrain vehicle routes. All streets are open to ATV and UTV traffic except U.S. Route 45/State Highway 22, which includes South Main Street, North Main Street, and West Madison Street.

Routes do not include public properties, cemeteries or city-owned parks, except for those with designated parking areas where motorized vehicles normally park. Any use in a park must be on paved areas regularly used by motor vehicles.

Routes also do not include private roads or driveways or private property in the city.

Streets that can be used by ATV/UTV operators will be marked with uniform ATV/UTV route signs.

ATV/UTV operators who use city roads “assume all the usual and normal risks of ATV/UTV operation” and “the city accepts no liability for the operation of ATVs/UTVs on any city streets under the provisions of this ordinance.”

ATV/UTV operators must abide by all traffic laws. The speed limit for ATVs/UTVs will not be greater than 35 mph or the speed limit for automobiles, whichever is lower.

Operators musts ride single file, and ride on the right-hand side of the paved portion of the highway unless making a left turn. A
n ATV/UTV cannot be operated within the city limits between midnight and 5 a.m. The only exception is for snow removal. The vehicles must meet all applicable federal noise and air pollution standards.

Operators under the age of 18 must wear approved protective head gear. No passengers are allowed unless the vehicle is intended to carry passengers. Operators must have in their possession a valid drivers license, and must carry liability and/or other insurances.

The ordinance can be enforced by any law enforcement officer authorized to enforce the laws of the State of Wisconsin.

The ordinance will expire within one year of its adoption unless an affirmative vote of the Clintonville City Council is made to continue the ordinance.
