Amherst man gets eight years for shooting brother

STEVENS POINT — Justin Wojtalewicz was sentenced to eight years in prison and six years of extended supervision for shooting and injuring his brother on March 16, 2025.
Following a jury trial on Nov. 7, Wojtalewicz was found guilty of mayhem with the use of a dangerous weapon, aggravated battery with the use of a dangerous weapon, and possession of a firearm as a convicted felon. He was found not guilty of attempted first degree intentional homicide and endangering safety/reckless use of a firearm.
The sentences for each guilty charge are set to run concurrent with one another, with a sentence credit of 360 days. Once the extended supervision begins, Wojtalewicz is to maintain full-time employment or schooling, not to enter an establishment whose primary purpose is the sale of alcohol, maintain absolute sobriety, complete a mental health evaluation and comply with recommended treatment, and more.
Wojtalewicz’s brother was shot in the leg above the knee after an altercation ensued in March 2025. His brother went to hug Wojtalewicz, which caused Wojtalewicz pain following a recent shoulder surgery. Following a brief physical fight, his brother attempted to leave the residence when he was shot on the porch by Wojtalewicz. He was taken to Wausau for medical treatment where he remained in critical condition for a time before recovering.
