$17 million wrongful death lawsuit

WAUPACA — The Togstad family has filed a multi-million dollar wrongful death civil lawsuit against a Tony Haase, 54, who was recently acquitted by a Waupaca County jury on Aug. 11 after a month-long trial. The lawsuit alleges that Tony Haase killed Tanna Togstad, 23, and Tominthy Mumbrue, 35, in March 1992.
Richard Togstad filed the suit on behalf of his deceased mother, Helen Hoffman, and his sister. The lawsuit is demanding $17 million in damages for inflicting physical and emotional suffering. The civil lawsuit was filed before the criminal trial was decided.
“While we respect the jury’s decision in the criminal case, the burden of proof in civil court is different. Civil cases require proof by a preponderance of the evidence — meaning it’s more likely than not that the defendant caused the harm — rather than the beyond-a-reasonable-doubt standard required for criminal conviction,” wrote attorney Joel Huotari said in a statement.
