68-year-old Waupaca man faces felony charge

Gary J. Herwig, 68, Waupaca, was charged Nov. 13 with possession of narcotics, possession of illegally obtained prescription drugs and possession of drug paraphernalia.

On Aug. 1, Waupaca County Deputy Nate Nelson questioned a 20-year-old Waupaca woman about drugs.

During the interview, Nelson looked at the woman’s cellphone and saw an instant message conversation between her and someone identified as “Fairy Gary.”

In the messages, the woman asked if she “could get 5.” She told Nelson the phrase referred to opiate prescription drugs.

The woman said “Fairy Gary” was her mother’s neighbor at Hillcrest Apartments in Waupaca.

A subsequent search of Herwig’s apartment found cut straws with white residue that tested positive for heroin and fentanyl.

Herwig has been summoned to appear in court on Dec. 3.

On Nov. 9, 2018, Herwig was convicted of delivery of marijuana and placed on 18 months of probation.

On Oct. 8, 2019, Judge Troy Nielsen ordered Herwig to spend 30 days in jail without work release privileges.
