Suspect accused of threatening probation agent

Judge Troy Nielsen has issued a warrant for the arrest of Josefina M. Nunez, 42, whereabouts unknown.

Waupaca County has charged Nunez with threatening bodily harm to a probation agent and telephone harassment.

On Nov. 2, Waupaca Police Officer Nicole Hahn was dispatched to the Probation and Parole Office on Churchill Street in Waupaca. She met with the probation officer who was overseeing a case involving Luis A. Cruz, 27.

Cruz is in custody in Waupaca County facing charges of battery, disorderly conduct and possession of marijuana.

According to the criminal complaint, the agent received a voicemail that started with the caller identifying herself as Cruz’s mother then reportedly asked what was happening with Cruz’s case.

“How about this, I destroy you, I take your (expletive) life. I already know your background, I already know who you’re married to and how many kids you got,” the message said.

Hahn reviewed calls that Cruz made from the jail.

“During the calls that I listened to, Cruz did not request his mother to contact the probation agent or make any threats,” Hahn reported.

Hahn also called the number where the threatening call originated. She spoke with a woman who identified herself as Jennifer Nunez and as Cruz’s mother.

Officer interviews suspect

Hahn asked her if she spoke to and threatened Cruz’s probation agent.

“Josefina then stated she wanted to talk to a lawyer and she was going to get Waupaca County fired like she did to Brown County,” Hahn noted.

“Josefina went on rambling and then stated I could speak to her lawyer and hung up on me.”

Police have been unable to determine whether Nunez currently lives in Green Bay or in Indiana.

Cruz has been in and out of prison multiple time since 2015.

In Brown County, Cruz was convicted of operating a vehicle without the owner’s consent in 2013, robbery with the use of force in 2014, making terrorist threats, threatening phone calls and intimidating a victim in 2018, and battery and criminal damage to property in 2020.

Cruz was released from prison on extended supervision in January 2022.

Munez was convicted in Brown County of battery, disorderly conduct and felony bail jumping in 2015, and of disorderly conduct and criminal damage to property in 2018.
