WAUPACA — Javier C. Abimael, 42, of Waupaca, was arrested for felony intimidation of a victim, false imprisonment, misdemeanor battery and disorderly conduct.
According to the criminal complaint, the charges are from a domestic violence incident on May 24, 2026 where Abimael assaulted a woman, prevented her from leaving a vehicle, and forcefully took her phone to stop her from contacting law enforcement.
Waupaca Police Officer Holden responded to a domestic disturbance call at 107 S. Main Street near the Waupaca Library at around 7:30 p.m. Upon arrival, Holden found that Sergeant Zube had already detained Abimael in handcuffs.
Before leaving the scene, Holden interviewed two witnesses who reported seeing Abimael chasing the victim down the road and physically beating her. One witness pointed out a silver vehicle with Wisconsin license plates parked near the intersection of South Main Street and Union Street, which Abimael had been driving.
When Holden approached the front passenger side of the vehicle, he observed an open bottle of Corona and blood splatter on both the front passenger seat buckle and the passenger-side floorboard and a wad of bloody toilet paper.
Holden interviewed the victim at the police station with a translator on the phone. The victim stated she and Abimael had been in a domestic relationship and living together at a residence on Waupaca Street for approximately three years. They were not married.
She wanted to break up but Abimael didn’t want that to happen. While they were inside the car, Abimael locked the doors and began hitting her. He hit her several times in the face and nose while cursing at her. When she got out and walked away from him, he grabbed her phone to prevent her from calling the police.
Investigators later obtained surveillance footage from the City of Waupaca that captured the encounter from 7:25 p.m. to 7:36 p.m. This is what happened:
The victim exited the vehicle near South Washington Street and Granite Street and walked toward South Main Street. Abimael followed slowly in his vehicle and parked on South Main. He tried forcing her into the car by bear hugging her. She escaped and walked down South Main. Abimael parked his vehicle near West Union Street and followed the victim. They argued on the east sidewalk near South Main Street and East Union Street. The victim tried to make a phone call and Abimael bear hugged her again, grabbed the phone and punched her and pulled her hair. He pushed her to the ground while holding two mobile phones. Concerned citizens ran over and separated Abimael from the victim.
